Legal liability
COVERED
What’s covered
There are differences in cover for your legal liability between our Home Building and Home Contents policies.
When you have AAMI Home Building Insurance, we cover your legal liability to pay compensation for death of or bodily injury to other people (not you), or loss or damage to their property, resulting from an incident which happens during the period of insurance in connection with either:
- you owning or living in the building, and the incident and death, injury loss or damage occurs wholly within the boundaries of the insured address
- a jetty or pontoon either:
- located within the boundaries of the insured address
- where part of its structure begins or terminates on the insured address or is on government owned land adjoining the insured address, and the jetty or pontoon is for your use.
We also cover you for associated legal costs to defend a claim against you that is covered. We need to first agree to pay the legal costs before they are covered.
With AAMI Home Contents Insurance, we provide cover for your legal liability to pay compensation for death of or bodily injury to other people (not you), or loss or damage to someone else's property, resulting from an incident which happens anywhere in Australia or New Zealand during the period of insurance if the incident is:
- unrelated to your ownership of the building, unit or land at the insured address
- you live in and/or own the unit and your legal liability isn't covered by a separate building or strata policy
- resulting from fixtures attached to the insured address that you’re legally responsible for under a rental agreement
- a jetty or pontoon not at the insured address that you’re legally responsible for:
- located within the boundaries of the insured address
- where part of its structure begins or terminates on the insured address or is on government owned land adjoining the insured address, and the jetty or pontoon is for your use.
We also cover legal costs associated with defending a claim against you, but we must agree to cover these costs beforehand.
Note this is only a summary of coverage details. Conditions and other exclusions apply. For more information on what is and what is not covered under ‘Legal liability’, please read the relevant Product Disclosure Statement.
